Terms of Service

By accessing or using the Sylk Health platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Platform.

These Terms apply to all visitors, users, and others who access or use the Platform, including but not limited to patients, healthcare providers, and healthcare organizations.

Sylk Health provides a technology platform that:

• Facilitates connections between patients and healthcare providers
• Provides general information about medical procedures and costs
• Enables appointment scheduling (without collecting medical data)
• Offers cost comparison tools and calculators
• Facilitates communication between parties (marketplace messaging only)

Sylk Health does not:

• Provide medical advice, diagnosis, or treatment
• Guarantee medical outcomes or results
• Employ or control healthcare providers
• Collect, store, or process medical records or health information
• Act as a Business Associate under HIPAA
• Verify the accuracy of all information provided by third parties

To use certain features of the Platform, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

Healthcare providers must additionally provide valid medical licenses and credentials for verification.

You acknowledge and agree that:

• All medical decisions are made between you and your healthcare provider
• Sylk Health does not recommend or endorse specific providers or treatments
• Medical information on the Platform is for informational purposes only
• You should verify all information with healthcare providers directly

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

As a marketplace platform that does not handle medical data, Sylk Health:

• Is NOT a HIPAA-covered entity or Business Associate
• Does NOT collect Protected Health Information (PHI)
• Complies with general data protection requirements for non-medical data
• Ensures all medical data is handled directly by healthcare providers
• Maintains standard commercial data security for platform operations

For services booked through the Platform:

• All prices are displayed in the currency specified
• Platform fees are clearly disclosed before booking
• Payment processing is handled by secure third-party providers
• Refunds are subject to provider cancellation policies
• You are responsible for any additional fees (travel, accommodation, etc.)

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

SYLK HEALTH PROVIDES THE PLATFORM "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM ALL LIABILITY FOR ANY MEDICAL OUTCOMES, COMPLICATIONS, OR ADVERSE EVENTS ARISING FROM MEDICAL PROCEDURES OR TREATMENTS OBTAINED THROUGH CONNECTIONS MADE ON THIS PLATFORM.

Sylk Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability shall not exceed the amount you paid to Sylk Health in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Sylk Health, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws

We may terminate or suspend your account immediately, without prior notice, for:

• Breach of these Terms
• Fraudulent or illegal activity
• Providing false information
• Behavior harmful to other users or the Platform

Upon termination, your right to use the Platform will cease immediately.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which you reside, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the applicable arbitration rules.
